Can somebody identify this fruit tree?

Growing in an inner Sydney garden.

Tree is about 4 m tall.

looks very similar to a tree i cut out, we were told it was a custard apple.

It's a species of Magnolia.

Looks to be one of the ornamental Asian
deciduous-leaved magnolias.
M. kobus and M. stellata are commonly
planted ornamentals with similar foliage to yours

Since there is some difference of opinion here, I will weigh in with a vote
for Magnolia. That was what rang my bell when I saw it. Leaves are right.
The fruit just isn't ripe yet.

Annonaceae seem to be much rounder than this. Leaves are different, too.
