Default Liberalism run amuck, Michigan Woman Faces 93 Days in Jail for Planting a Vegetable Garden

It just doesn't get more ridiculous than this.

Julie Bass of Oak Park, Michigan -- a mother of 6, law-abiding citizen,
and gardener -- is facing 93 days in jail after being charged with a
misdemeanor.

Her crime? Planting a vegetable garden in the front yard.


Bass says that she planted the garden after her front yard was torn up for
some sewer repairs. Rather than wasting the opportunity to start with a
clean slate by planting a lawn, she decided to really put the area to use,
and plant a vegetable garden.

Her garden consists of 5 raised beds, where she grows a mix of squashes,
corn, tomatoes, flowers, and other veggies. Bass received a warning from
the city telling her to remove the vegetable garden, because it doesn't
adhere to city ordinances (more on that later.) When she refused, she was
ticketed and charged with a misdemeanor. Her trial, before a jury, is set
to begin on July 26th. If she is found guilty, she can be sentenced to up
to 93 days in jail.

About the City Ordinance

Supposedly, Bass is in noncompliance with a city ordinance that states
that only "suitable" plant material is allowed on the lawn area of
residences. When local media asked city planner Kevin Rulkowski what that
meant, he said suitable means "common:" lawn, nice shrubs, and flowers.
However, the city ordinance does not specifically state that those are the
only allowed plant materials.

About Oak Park

This is not some gated community with HOA regulations. This is an
ordinary, working class neighborhood in Oakland County, Michigan. Like
nearly every other city in my home state right now, Oak Park is facing
financial issues. Here at home, people are amazed that a cash-strapped
city has the resources to investigate, charge, and prosecute a resident
for something as innocuous as planting a vegetable garden.

What's Being Done

This story is gaining traction all over the web. Gawker covered it this
morning. There are Facebook pages devoted to supporting Mrs. Bass and her
family during this ordeal. Will social media help change the city's mind?
That's what many of us are hoping. Local television affiliates for ABC and
Fox news have already covered the story, and media attention continues to
grow.

How to Help

If you want to help support a gardener's right to grow food for her family
(even if it is -- gasp -- in the front yard!) there are several things you
can do:

1. Email or call officials for the city of Oak Park. Mrs. Bass has listed
contact information for the mayor, city manager, and other city officials
in the sidebar of her blog.

The Clinton White House apparently used a toxic sludge-based product to
fertilize the lawn during the 1990s! Aside from casting a shadow on the
first White House vegetable garden since Eleanor Roosevelt resided
there, the sludge ensures that Michelle's garden will never attain
organic status. Organic certification processes strictly prohibit the
use of sludge as a fertilizer substitute.

offenses is a conservative policy. For all the bleeting about freedom, the

I am not sure, I believe one should obey the rules of the community in
which they live. If one lives in the suburbs I can see having rules against
owning horses or goats and ordinances for keeping a nice lawn. It can
devaluate the neighbors home. If one lives in a condominium, try even
having a tomato plant on the back patio without having the associations
approval. I can see where the majority wants a certain look and feel to a
community. If that person wants to do otherwise they should move somewhere
else.

In the country where I live there are no such ordinances. I do not even
have to mow my lawn and I can have old rusted out cars on my front lawn and
no one would say or do anything about it.

I am not sure, I believe one should obey the rules of the community in
which they live. If one lives in the suburbs I can see having rules
against

There are very valid health reasons for having rules against keeping horses
or pigs or poultry, but having rules for keeping "a nice lawn"? That is
simply about control and restriction of choice.

It can

people have airplanes and small jets with small hangers instead of garages
next to there homes with a shared runway. Boating communities. Communities
with golf courses. Communities where there are elderly only no kids... Each
community with their own flavor, some with grass lawns only. Choose your
home, choose your lifestyle. I choose the country where there are few
restrictions.

When I was a kid. I use to ride my bicycle through Oak Park Michigan to get
the Americana Theater. Nice city forty years ago. Today If you ride your
bike there... Pedal Fast if you want to keep your bike.

Bad laws make bad citizens. How does growing a tomato reduce the quality
of life for the elderly, or those with a "busy city life style"

Communities where there are elderly only no kids... Each
community with their own flavor, some with grass lawns only. Choose your
home, choose your lifestyle.


Some have accused homeowners associations of selective enforcement of
these rules, making a case only when it is something (or someone)
another person dislikes. Breaking a rule, even unintentionally, can
bring fines or even a lien on the home. In extreme cases, a homeowners'
association may file a lawsuit against an owner who violates the
covenants or even foreclose the property.

Restrictive covenants have evolved with some being found to be illegal,
i.e. Shelley v. Kraemer. Restrictive covenants that bar the growing of
food, that don't involve health risks, make no sense (or worse) in
today's world, where a handful of corporations control what we eat.

I choose the country where there are few
restrictions.


With more money comes more choices with fewer restrictions (and more
freedom), a plutocracy, if you will, which is indicative of our "Zeit
Geist".

allowed, like Mackinaw Island in Michigan. There are communities where
people have airplanes and small jets with small hangers instead of garages
next to there homes with a shared runway. Boating communities. Communities
with golf courses.


The above refer to zoning laws.

Communities where there are elderly only no kids... Each
community with their own flavor, some with grass lawns only. Choose your
home, choose your lifestyle.


Some have accused homeowners associations of selective enforcement of
these rules, making a case only when it is something (or someone)
another person dislikes. Breaking a rule, even unintentionally, can
bring fines or even a lien on the home. In extreme cases, a homeowners'
association may file a lawsuit against an owner who violates the
covenants or even foreclose the property.

Restrictive covenants have evolved with some being found to be illegal,
i.e. Shelley v. Kraemer. Restrictive covenants that bar the growing of
food, that don't involve health risks, make no sense (or worse) in
today's world, where a handful of corporations control what we eat.

I choose the country where there are few
restrictions.


With more money comes more choices with fewer restrictions (and more
freedom), a plutocracy, if you will, which is indicative of our "Zeit
Geist".

Now that is an interesting thought. I would have to say that is probably
true. Those that live in a congested areas probably does have extra rules
in order to live with each other. In the boondocks who cares. My little dog

My Uncle that lives in a condo does nothing that changes the look of the
area. I have a hard time finding his home, I go there twice a month to
visit. They all look alike, they all even have the same white rocking chair
porch furniture.

In the original posted article, the woman that faced 93 days in jail was
from Oak Park, Michigan that had that vegetable garden in her front yard.
The neighboring city was my childhood stomping ground. I do not know that
person or home, but I am familiar with that neighborhood. The last time I
rode my bike there, I was chased by a gang of black kids wanting my nice
$800 road bike around the 1970's. Paper Routes paid better than one thinks
in those days

Her garden consists of 5 raised beds, where she grows a mix of squashes,
corn, tomatoes, flowers, and other veggies. Bass received a warning from
the city telling her to remove the vegetable garden, because it doesn't
adhere to city ordinances (more on that later.) When she refused, she was
ticketed and charged with a misdemeanor. Her trial, before a jury, is set
to begin on July 26th. If she is found guilty, she can be sentenced to up
to 93 days in jail.

About the City Ordinance

Supposedly, Bass is in noncompliance with a city ordinance that states
that only "suitable" plant material is allowed on the lawn area of
residences. When local media asked city planner Kevin Rulkowski what that
meant, he said suitable means "common:" lawn, nice shrubs, and flowers.
However, the city ordinance does not specifically state that those are the
only allowed plant materials.

About Oak Park

This is not some gated community with HOA regulations. This is an
ordinary, working class neighborhood in Oakland County, Michigan. Like
nearly every other city in my home state right now, Oak Park is facing
financial issues. Here at home, people are amazed that a cash-strapped
city has the resources to investigate, charge, and prosecute a resident
for something as innocuous as planting a vegetable garden.

What's Being Done

This story is gaining traction all over the web. Gawker covered it this
morning. There are Facebook pages devoted to supporting Mrs. Bass and her
family during this ordeal. Will social media help change the city's mind?
That's what many of us are hoping. Local television affiliates for ABC and
Fox news have already covered the story, and media attention continues to
grow.

How to Help

If you want to help support a gardener's right to grow food for her family
(even if it is -- gasp -- in the front yard!) there are several things you
can do:

1. Email or call officials for the city of Oak Park. Mrs. Bass has listed
contact information for the mayor, city manager, and other city officials
in the sidebar of her blog.

I'm quite sure there are places which say they are a 'community' and have
extremely strict rules. That does not meant hat they have any idea
whatsoever of what 'community' means.
