roots with something it's taken over my raised bed as well can't grow

I would suggest that you have chat with your neighbours, doing anything to
the tree even if its legal will cause bad feelings and make both your lives
a misery.

And it may be worth a *gentle* hint that his and your insurers will
take a very dim view if he does nothing and damage is caused to your
property or his.

You are perfectly entitled to cut the roots and any branches encroaching and
overhanging your property (provided you give them back to the owner) AND you
can claim for any damage to your property caused by the tree roots.

What you *CANNOT* do, is *LEGALLY* kill or damage any part of the tree that
is not on or overhanging your property.

That said, I would suggest that you have a chat with your neigbour and ask
him to remove the tree and kill or remove the stump before you take any
action.

Have a look at this link http://www.gardenlaw.co.uk/ and you may infromation
there from people who are far more qualified that I to give it.

For information, my neghbour had a mature sliver birch in his garden whose
roots were literally hitting my house wall several metres away and partially
lifting some patio paving, an overhanging branch was hitting my garden shed
roof and causing minor fence damage. A pleasant and non-confrontational chat
to him to explain the situation resulted in him having the tree
professionally removed and the stump flooded with a chemical to kill it
(removal would have caused even greater damage) - drinks all round at my
expense a few days later as a thank you.
