I have moved into a house that has a Silver Birth in the Garden (6-7
meters Tall) and the top 3rd is leafless (The rest looks fine), is it
dying?

Could just be dropping its leaves early 'cos of water shortage. A lot of
trees round my way (W Herts) have done that, although not noticiably the
mature birches. I suspect you'll have to wait until next year to find
out.
