Don't know about ten feet high trees being able to damage houses, but some
mature maple trees can reach a height of 120 feet with a canopy span of 80
feet. That means their roots will eventually reach out at least 40 feet in
all directions. That tree poses a very serious potential hazard to any
houses around it, including the owners. I sure wouldn't want that tree
growing within ten feet of my house, garage or property line.

Trees along city streets generally are on the city's right of way and as
such are the property of the city. I assume the city or possibly the
property owners on whose property the trees are growing would be responsible
for any damage cause by them falling. As far as the birds, I keep my car in
my garage; others in my neighborhood garage their cars or cover their cars
with tarps as needed.

It seems to me that narrow space between your house and theirs is not

enough for a tree that will eventually reach the height and breadth yours
will. That is a maple tree, isn't it.

In my opinion, that tree should never have been planted there in the

first
place.
