Default Erecting garden fence on my side

om...
i have to renew all the fence but there is a simple chain link fence
and my neighbour has planted trees and shrubs right on the fence line
!
this is my side which has to be maintained by me , but to erect the
fence i have to remove or cut into the plants that he has planted slap
bang on the fence line !
i dont want to get into a dispute but how can i build the new fence ?
if i cut into the half of the tree to enable the fence the tree will
presumably die as half the trunk will be removed .

You are legally entitle to cut ALL branches back to the boundary however its
best to do this in front of witnesses as its clear your neighbour intended
to make life difficult
Do not remove the chain link or its posts or you will find yourself in
another argument with the neighbour claiming you have moved the boundary
Instead install a new fence and wire the chain link into it every foot or so
.........so that you cant be accused of anything
You are also entitled to cut back all roots to the boundary although if the
trees fall over he might claim you caused it but since you are fully
entitled to dig every inch of your garden the only answer is to ensure you
regularily dig the boundary
