Liberalism run amuck, Michigan Woman Faces 93 Days in Jail for Planting a Vegetable Garden

_veggie_garden.php

It just doesn't get more ridiculous than this.

Julie Bass of Oak Park, Michigan -- a mother of 6, law-abiding citizen,
and gardener -- is facing 93 days in jail after being charged with a
misdemeanor.

Her crime? Planting a vegetable garden in the front yard.

Bass says that she planted the garden after her front yard was torn up for
some sewer repairs. Rather than wasting the opportunity to start with a
clean slate by planting a lawn, she decided to really put the area to use,
and plant a vegetable garden.

Her garden consists of 5 raised beds, where she grows a mix of squashes,
corn, tomatoes, flowers, and other veggies. Bass received a warning from
the city telling her to remove the vegetable garden, because it doesn't
adhere to city ordinances (more on that later.) When she refused, she was
ticketed and charged with a misdemeanor. Her trial, before a jury, is set
to begin on July 26th. If she is found guilty, she can be sentenced to up
to 93 days in jail.

About the City Ordinance

Supposedly, Bass is in noncompliance with a city ordinance that states
that only "suitable" plant material is allowed on the lawn area of
residences. When local media asked city planner Kevin Rulkowski what that
meant, he said suitable means "common:" lawn, nice shrubs, and flowers.
However, the city ordinance does not specifically state that those are the
only allowed plant materials.

About Oak Park

This is not some gated community with HOA regulations. This is an
ordinary, working class neighborhood in Oakland County, Michigan. Like
nearly every other city in my home state right now, Oak Park is facing
financial issues. Here at home, people are amazed that a cash-strapped
city has the resources to investigate, charge, and prosecute a resident
for something as innocuous as planting a vegetable garden.

What's Being Done

This story is gaining traction all over the web. Gawker covered it this
morning. There are Facebook pages devoted to supporting Mrs. Bass and her
family during this ordeal. Will social media help change the city's mind?
That's what many of us are hoping. Local television affiliates for ABC and
Fox news have already covered the story, and media attention continues to
grow.

How to Help

If you want to help support a gardener's right to grow food for her family
(even if it is -- gasp -- in the front yard!) there are several things you
can do:

1. Email or call officials for the city of Oak Park. Mrs. Bass has listed
contact information for the mayor, city manager, and other city officials
in the sidebar of her blog.

http://oakparkhatesveggies.wordpress.com/

2. "Like" the Oak Park Hates Veggies Facebook Page.

https://www.facebook.com/pages/Oak-Park-Hates-
Veggies/184553881597878?v=wall

3. Spread the word via Facebook and Twitter. By gaining attention to this
particular issue, with this particular homeowner, the hope is that other
cities will reconsider before they harass another homeowner for something
like this.

What do you think? Should a front yard vegetable garden be a crime?

uh-oh. once people begin planting more VEGETABLES, they'll start getting
HEALTHY too! good health could cause CLEAR THINKING, which might lead to
AWARENESS of the source and impact of everyday food choices on both
personal health and planet. awareness is likely to result in BREAKING
ADDICTIONS to the toxic chemicals in processed foods and then REFUSING to
purchase or consume the dangerous packaged/processed/GMO substances which
are poisoning the average american eater every day. from there it's
inevitable that the innocent vegetable planter will eventually be
TRANSFORMED into a happier, healthier person supporting a happier,
healthier planet AND will start to INFORM their friends and family about
how they got that way, INSPIRING others to plant their own veggies too...

Cut and paste from facebook?

The Clinton White House apparently used a toxic sludge-based product to
fertilize the lawn during the 1990s! Aside from casting a shadow on the
first White House vegetable garden since Eleanor Roosevelt resided
there, the sludge ensures that Michelle's garden will never attain
organic status. Organic certification processes strictly prohibit the
use of sludge as a fertilizer substitute.

I am not sure, I believe one should obey the rules of the community in
which they live. If one lives in the suburbs I can see having rules against
owning horses or goats and ordinances for keeping a nice lawn. It can
devaluate the neighbors home. If one lives in a condominium, try even
having a tomato plant on the back patio without having the associations
approval. I can see where the majority wants a certain look and feel to a
community. If that person wants to do otherwise they should move somewhere
else.

In the country where I live there are no such ordinances. I do not even
have to mow my lawn and I can have old rusted out cars on my front lawn and
no one would say or do anything about it.

There are very valid health reasons for having rules against keeping horses

simply about control and restriction of choice.

It can
devaluate the neighbors home.

I'd pay more for a place with a decent dry garden rather than a 'nice lawn'.

The US has different kinds of communities and I believe those that are like

people have airplanes and small jets with small hangers instead of garages
next to there homes with a shared runway. Boating communities. Communities

Some have accused homeowners associations of selective enforcement of
these rules, making a case only when it is something (or someone)

bring fines or even a lien on the home. In extreme cases, a homeowners'

So, freedom only belongs to the landed (wealthy)? This may square with
the reality of American history, but certainly not its ideals.

Now that is an interesting thought. I would have to say that is probably
true. Those that live in a congested areas probably does have extra rules
in order to live with each other. In the boondocks who cares. My little dog
barks half the night on the back deck, the dog comes and goes as he
pleases. In the city I would be buried in tickets for disturbing the Peace.

But I will also say, it is a choice, one can have a home in country with
acreage for the same price for a nice home in the city. The city has many
conveniences that country life does not and same goes for the country. The
city life has more entertainment options, the country has it better gardens
and animal options.

Communities where there are elderly only no kids... Each
community with their own flavor, some with grass lawns only. Choose your
home, choose your lifestyle.

Some have accused homeowners associations of selective enforcement of
these rules, making a case only when it is something (or someone)
another person dislikes. Breaking a rule, even unintentionally, can
bring fines or even a lien on the home. In extreme cases, a homeowners'
association may file a lawsuit against an owner who violates the
covenants or even foreclose the property.

My Uncle that lives in a condo does nothing that changes the look of the
area. I have a hard time finding his home, I go there twice a month to
visit. They all look alike, they all even have the same white rocking chair
porch furniture.

When I was a kid. I use to ride my bicycle through Oak Park Michigan to get
the Americana Theater. Nice city forty years ago. Today If you ride your
bike there... Pedal Fast if you want to keep your bike.

Where does this come from, and how does it fit into the discussion?
Crime changes with time. When there was a large middle class, middle
class ethics motivated people. As the middle class disappears, we are
left with the ethics of the upper and lower classes who know you only
get what you can take.

In the original posted article, the woman that faced 93 days in jail was
from Oak Park, Michigan that had that vegetable garden in her front yard.
The neighboring city was my childhood stomping ground. I do not know that
person or home, but I am familiar with that neighborhood. The last time I
rode my bike there, I was chased by a gang of black kids wanting my nice
$800 road bike around the 1970's. Paper Routes paid better than one thinks
in those days :)

Yep, but they were cleverer than calling it that. It was implemented by a
'Dictation test'. Language of test not specified so if anyone of dusky hue
who was not wanted applied, they could be given a test in any language. If
they did happen to be of a dusky hue but wanted for some reason, then they
would/could of course be given the Dictation test in their native language
thus guaranteeing admission to our hallowed shores. But we don't have such
a thing these day. These days we're not so fussy about colour - except for
poor sods who risk life and limb try to come here on boats after paying
people smugglers.

In the US it is illegal to prevent any person of color from living where
they want. When they get there they may or not have restrictions on the

You missed the point. Segregation and apartheid were specifically based on
skin colour but just because those rules you mention may (note the use of
the word 'may') have nothing whatsoever to do with colour, that sort of
mindset that was the source of being discriminatory or controlling or
restrictive or unwelcoming etc etc, is exactly the same. "We don't want
your sort round here". "That sort" might just be someone who wants to grow
vegetables, but once you start that sort of silly rule, where do you end?

I can certainly understand rules relating to health and safety issues such
as those relating to barking dogs, keeping poultry or horses or playing
music for more than an short time each day or at excessive noise levels, but
growing tomatoes on a deck or in front yard or an insistence on having a
'nice lawn'????

The folks at Housing Opportunities Made Equal conducted a “fair housing

In two-thirds of the visits — 66 percent — HOME says that white testers
were offered lower rent, lower security deposits, lower fees, and shown
other available units. Black testers were more likely to be asked for
identification to view units, and white testers were more likely to
receive follow-up calls.

I suppose it isn't, but it is a restrictive covenant. Can a property
owner make whole their ownership of their property? It is clear that a
court can remove racial covenants (Shelley v. Kraemer). I suppose the
answer is to keep nibbling at the legally questionable edges of the
covenant until it becomes so restrictive that the homeowners association
is disbanded. Neighbor may even have to learn to talk and cooperate with
each other.

http://en.wikipedia.org/wiki/Restrictive_covenant
Some have accused homeowners associations of selective enforcement of
these rules, making a case only when it is something (or someone)
another person dislikes. Breaking a rule, even unintentionally, can
bring fines or even a lien on the home. In extreme cases, a homeowners'
association may file a lawsuit against an owner who violates the
covenants or even foreclose the property.

Illegal taking of property, perhaps.

In any event, here, the ordinance was vague, and merely required the use
of usual (common) plants. Does an autocratic, pencil pushing bureaucrat
get to be the final judge on what is usual?

Intercourse the bureaucrat.

No, gone for years. Abolished about the time when colour did make a
difference to where people of different skins could live (and work and go to
school) in the US. We have huge immigration from Hong Kong, China, Vietnam
and some from the rest of Asia, Africa and the Pacific.

We never had that. Despite the so-called white Australia policy quite a lot
of non-whites made it to these shores (many Chinese in the 19th century) and
once here they went wherever they liked.

So tying a young gay man to a fence in Wyoming in winter so he can freeze to
death (after a savage beating) is a trivial offense?

Paul-

It's manslaughter or murder. Not trivial.

You don't have to hang tinsel on it to get the legal system's
attention.

Right, overt race restrictive covenants are forbidden now (Shelley v.
Kraemer). Now it is all done with a wink and a nod.

But how is it discriminating to require all homes in that community to
have
a manicured front lawn?

On the basis of race, it wouldn't be. But that is way too specific an
example. It's about making rules that tells anyone who owns a house in that
area, what is 'suitable' planting. That is about taste and style.
