Clara Harris sentenced to 20 years

Woman who ran over husband plans to appeal
Clara Harris, center, is comforted by her attorneys as she collapses
in sobs after the sentence was read.

HOUSTON, Feb. 14 — Clara Harris, the Houston woman convicted of
murder for running down her philandering husband after catching him
with his mistress, was sentenced to 20 years in prison Friday, which
would have been the couple's 11th wedding anniversary. Her attorneys
immediately planned to appeal the sentence, contending that crucial
evidence had been excluded.

Harris' attorney said the judge was wrong to rule out a tape-recorded
statement she made to police the morning after her husband's death.

JURORS DELIBERATED about six hours before returning the
sentence, the day after they found her guilty of murder in the
nationally watched case.
Harris, 45, a prominent Houston dentist, slumped to the defense
table in sobs as the sentence was read. Jurors also assessed a $10,000
fine.
The sentence, at least half of which she must serve before she
can be paroled, was a mixed verdict for Harris, who could have been
sent to prison for life.
Jurors told state District Judge Carol Davies that they had
found the special circumstance of "sudden passion," a legal term that
means Harris acted "from an adequate cause sufficient to render the
mind incapable of cool reflection," according to the Texas Penal Code.
Harris' attorneys had made the argument in an attempt to win
probation, the lightest possible sentence. In the end, however, while
the nine-woman, three-man jury accepted the sudden passion argument,
it decided to impose the maximum penalty allowed under those
circumstances.

HARRIS TO APPEAL
George Parnham, Harris' lead attorney, told reporters afterward
that his client was "devastated," but he reassured family members that
there was no danger that she might try to commit suicide, a concern
some of her relatives had raised.
Parnham said he would appeal the sentence, pursuing issues of
excluded evidence "as hard as we pursued them before the verdict."
He insisted that Davies was wrong to rule out a tape-recorded
statement Harris made to police the morning after her husband's death.
Davies ruled that the tape could be introduced as evidence only by the
prosecution, which chose not to do so.

Parnham said the tape would have convinced jurors that Harris
was not responsible for her actions.
"The entirety of the tape ... supports a condition on the part
of Clara Harris of incoherency, rambling, unbelievable off-the-wall
comments and statements by her to that officer," he said.
Prosecutor Mia Magness said the jury sent a "clear message"
that "if you unlawfully take a human life, for whatever reason, you're
going to go to jail."
Magness said Davies' ruling on the audiotape was "reasonable
and fair" and showed that "he criminal justice systems works."
"I believe that justice was done today," she said.

DRAMATIC END TO TRIAL
The sentencing ended three tense days in which Harris' fate was
left in the hands of the jurors, who deliberated eight hours over
Wednesday and Thursday before returning the conviction. Two of the
jurors cried as Davies read the verdict in court.

Parnham had urged jurors to consider Harris' mind-set as she
sat in a Mercedes-Benz and watched her husband, David Harris, 44, an
orthodontist, come off a hotel elevator hand in hand with his
receptionist, Gail Thompson Bridges. He said later that the exclusion
of the police audiotape was a critical setback that made his argument
much harder.
Prosecutors called a half-dozen witnesses who said they watched
in disbelief as Harris ran over her husband at least twice. Clara
Harris said many of the events were a "dream" to her.
Prosecutors recalled some of their witnesses to reinforce the
impact of Harris' actions on her family.
Lindsey Harris — David Harris' 17-year-old daughter and Clara
Harris' stepdaughter, who was a passenger in the car — testified
Thursday that she tried to commit suicide several times after her
father's death.

EMOTIONAL OUTBURST
The jurors were sent away Thursday when Clara Harris began to
sob, after which she cried out to her stepdaughter, who has filed a
wrongful death lawsuit against her.
‘I'm sorry, Lindsey. I'm sorry, baby.'
— CLARA HARRIS
To stepdaughter in courtroom "I'm sorry, Lindsey. I'm sorry,
baby," Harris cried, earning an admonishment from Davies.
Parnham called David Harris' father, Gerald Harris, who had
testified earlier for the defense that Clara Harris loved his son.
"Our motivation stems from the word ‘forgiveness,'" Harris
said. "We feel like a member of our family has erred, and we forgive
that. We don't feel like Clara intended to kill David."

HARRIS: I TRIED TO SAVE MARRIAGE
During the trial, Clara Harris told jurors that she tried to
save her marriage after learning of her husband's affair with Bridges.
She said she scheduled breast enhancement and liposuction operations,
joined a gym, quit her job, cooked her husband's favorite meals and
had sex with him three times a night in the week leading up to his
death.
Magness acknowledged to jurors that "there is a level of
desperation there that I know touches you and you feel sorry for her
because of it." But, she said, "you cannot excuse what she did
intentionally and knowingly because she was hurt."

What the media never mentions is the fact that she is an Armenian by
birth. Even though she shaves daily, the 5 o'clock shadow and the flies
swarming her arm pits constantly are a dead give-away.

I'm a black, old, not very old though, not ugly, not gorgeous,
not poverty-stricken, not rich, not stupid, not a genius, not normal,
not wierd. I'm just a pretty average gay guy, sexually a "bottom",
single and sane and I like Asian men. I'm in eastern
USA, I have my own place, and lead a pretty quiet life. I like to go
out to a movie, to dinner, to the beach, to the woods, anywhere where
booze, drugs and outrageous gay bar-room life doesn't rule the
day.Although I have a passion for sky diving. I
don't need sex on a daily basis, but rather I need a loving, cuddling,
tender companion who is a one-man-man, and who likes to just BE with
the man he loves. I'm looking for a real beginning to a long-lasting
relationship. And all I know about "him" is that he'll be Asian, he'll
be fairly slender, fairly young and fairly smart. And he'll know how
it is, just like *I* know how it is, to be lonely, and he'll be ready,
like me, to be a PARTNER in a real and honest union. It's time. Let's
just do it. Let's take the plunge. Fear of intimacy is no longer an
option. Drop me a note....say "Hello".
I also love a true perverted man who loves a lick here and there.
