Indeed it would seem to be a real loophole, now that so many people work from home, as all they have to do is claim that the hedge is round their workplace and not their private dwelling. I'm sure the local council (actually, they won't as business rates go into a central pool) will be delighted at the higher rates payable, as will the inland revenue with the capital gains tax when they come to sell. Shouldn't the law apply to all complainants? the (proposed) law is specifically designed to deal with cases of homeowners whose lives are blighted by oppressively high hedges. (1) This Act applies to a complaint which— (a) is made for the purposes of this Act by an owner or occupier of a domestic property; and (b) alleges that his reasonable enjoyment of that property is being adversely affected by the height of a high hedge situated on land owned or occupied by another person. pk |
